The rules for using this website, how engagements and billing work, and a clear statement that every account and asset stays in your name.

The short version
Use the site sensibly. The words and images on it belong to us. Every account, asset, and piece of content we create or manage for you belongs to you, completely, and that is written into every agreement we sign. Nothing on this website is a contract by itself, and nothing on it is professional advice for your specific situation.
Using this site
You are welcome to read, print, and share anything published here. What you may not do is scrape the site at scale, attempt to break or overload it, misrepresent yourself when contacting us, use the form to send unsolicited commercial messages, or copy our written content and publish it as your own.
We may change, move, or remove anything on the site at any time without notice. We try to keep old links working but we cannot promise every URL will exist forever.
Who owns what
This website
The copy, design, photography, code, and the Orca name and marks on this site belong to Orca Marketing. You may quote short passages with attribution and a link. You may not republish substantial portions, and you may not use our name or marks in a way that suggests we endorse you.
Your accounts and your work
This is the part that matters most and it works in your favour. Advertising accounts, analytics properties, domains, listings, email platforms, social profiles, and your CRM are registered in your name from day one, not ours. Content, creative, copy, and campaign assets transfer to you in full on payment.
We do not hold your accounts hostage. If you decide to leave, we remove our access and everything keeps running, because it was never in our name to begin with. This is stated here because a surprising number of agencies do the opposite, and because we are happy to be held to it.
Our tools
Revenue Radar, Sonar, Pod, and Current are our own software and are provided as part of an active engagement rather than sold or licensed to you. The outputs belong to you: the audit document, the reporting, and the data are yours to keep and to take elsewhere. The software itself stays with us.
Things we cannot transfer
Licensed typefaces, stock photography, and third party software remain governed by their own licenses, which we disclose in writing before they are used and before you pay for anything that depends on them. We also keep the right to show completed work in our own portfolio unless you ask us not to, which some clients do and which we always respect.
Engagements, billing, and cancellation
The audit is a fixed fee agreed in writing before it begins. Ongoing marketing is quoted as a fixed monthly scope, and after the initial build period it runs month to month.
- Monthly fees are billed in advance and cover the scope named in your agreement.
- Advertising budget is separate from our fee, is paid to the platforms on accounts in your name, and is never marked up by us.
- Change orders exist only when you ask for something outside the agreed scope, and they are quoted before any work begins.
- Either side can end an ongoing engagement with thirty days written notice, and we hand over everything within that window.

Prices quoted anywhere on this site are typical ranges, not offers. An actual price only exists once we have scoped your work and put a written proposal in front of you.
What we do not promise
We are direct about this rather than hiding it in capital letters at the bottom of the page. This website is provided as it is. We do not warrant that it will be uninterrupted, error free, or that every piece of information on it is current.
Nobody can honestly guarantee search rankings, traffic figures, ad performance, or revenue outcomes, and anyone who does is either mistaken or selling something. Search engines and advertising platforms change their rules without notice and we do not control them. What we guarantee is the work itself, the transparency, and that we will tell you when something is not performing rather than hide it in a chart.
Limitation of liability
To the fullest extent the law allows, Orca Marketing is not liable for indirect, incidental, or consequential damages arising from your use of this website or from third party platform decisions outside our control. For client engagements our total liability is limited to the fees paid for the specific work in question, and that limit is stated in the agreement you sign rather than only here.
Some states do not allow certain limitations, so parts of this may not apply to you. Nothing here is intended to limit liability for fraud or for anything else the law does not permit us to limit.
Links to other sites
We link to other websites where they are useful, including our sister companies at orca.agency, orcacreative.io, and orcait.io. We do not control third party sites and we are not responsible for their content, accuracy, or privacy practices. Their terms apply once you leave ours.
Governing law
These terms are governed by the laws of the State of [Your State] and the United States, without regard to conflict of law principles. Any dispute that cannot be resolved by a straightforward conversation will be handled in the state or federal courts located in [Your State].
We would genuinely rather pick up the phone. In more than a decade we have not needed this clause once, and we would like to keep it that way.
Changes to these terms
We may update these terms as the business changes. The effective date at the top of this page will always tell you which version is current. Continuing to use the site after a change means you accept the updated terms. This version took effect on July 27, 2026.
